TERMS & CONDITIONS

Last updated: August 2026

OVERVIEW

This website is operated by Swenka® Limited, an Irish registered company ("SWENKA®", "Swenka", "we", "us" or "our").

Throughout the website, the terms "you" and "your" refer to any visitor to our website or customer purchasing products from us.

SWENKA® offers this website, including all information, content, features, tools, products and services available through it (collectively, the "Services"), subject to these Terms & Conditions.

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to sell our products to you.

By visiting our website, using our Services or purchasing something from us, you agree to be bound by these Terms & Conditions together with any policies referred to in them, including our:

  • Returns & Refunds Policy

  • Shipping Policy

  • Privacy Policy

  • Cookie Policy

Please read these Terms carefully before using our website or placing an order.

Nothing in these Terms is intended to exclude, restrict or affect any statutory rights that you have under applicable consumer law.

1. ABOUT US

The seller of products purchased through this website is:

Swenka® Limited
Company Registration Number: 672653
Ireland
Email: connect@swenkastreetwear.com

SWENKA® is a registered trademark. The SWENKA name and associated branding are protected by registered trademark rights in Ireland and the United Kingdom.

2. ELIGIBILITY AND USE OF OUR WEBSITE

By placing an order through our website, you confirm that you are legally capable of entering into a binding contract.

If you are under 18, you should only use this website and make purchases with the involvement and permission of a parent or legal guardian.

You agree to provide accurate, current and complete information when placing an order or creating an account.

If you create an account, you are responsible for maintaining the confidentiality of your login details and for activity carried out through your account.

You may not use our website or Services for any unlawful or fraudulent purpose.

3. OUR PRODUCTS

We make reasonable efforts to display and describe our products as accurately as possible.

However, colours may appear differently depending on the screen, device, display settings or browser you use.

Many SWENKA® garments are individually printed and produced to order. Because of the nature of garment production and printing, minor variations in print placement, dimensions, colour and finish may occur between individual products.

Such minor variations do not affect your statutory rights where a product is faulty, damaged, not as described or otherwise fails to conform to the contract.

Product photographs, illustrations and mock-ups are provided to represent the product as accurately as reasonably possible but may not always represent minor manufacturing variations.

We may update product descriptions, designs, specifications and availability from time to time.

We may also discontinue products or limit quantities available for purchase.

Nothing in these Terms excludes your statutory rights concerning the quality, description, fitness for purpose or conformity of goods.

4. MADE-TO-ORDER PRODUCTS

Many SWENKA® products are produced specifically after an order is placed rather than being held as finished stock.

Production may therefore begin shortly after we receive and accept your order.

Please check your chosen product, colour, size, delivery address and other order information carefully before completing your purchase.

If you notice an error after placing an order, contact us immediately at connect@swenkastreetwear.com.

We will make reasonable efforts to accommodate changes or cancellations before production begins, but we cannot guarantee that an order can be changed once it has entered production.

The fact that a standard product is produced after an order is received does not, by itself, remove any statutory cancellation rights that may apply to your purchase.

Where we offer a genuinely personalised or customised product that is made to specifications supplied by you, different cancellation rights may apply. Any such restriction will be clearly communicated before purchase.

Please see our Returns & Refunds Policy for further information.

5. ORDERS AND CONTRACT FORMATION

When you submit an order through our website, you are making an offer to purchase the products contained in your order.

After you place your order, you will normally receive an email acknowledging that we have received it.

Receipt of an order acknowledgement does not necessarily mean that we have accepted your order.

A binding contract between you and SWENKA® is formed when we accept your order and confirm that acceptance to you.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including where:

  • a product is unavailable;

  • there has been an obvious pricing or product-description error;

  • payment cannot be authorised;

  • we reasonably suspect fraud or unauthorised activity;

  • delivery cannot reasonably be made to the address supplied; or

  • accepting the order would breach applicable law.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled product or order.

6. PRICES AND PAYMENT

Product prices are displayed on our website in the currency shown at checkout.

The price payable is the price displayed when you place your order, subject to correction of obvious pricing errors.

We may change our prices at any time, but price changes will not normally affect orders that we have already accepted.

Payment must be made using one of the payment methods offered at checkout.

You confirm that you are authorised to use the payment method provided.

Any applicable delivery charges will be clearly displayed before you complete your purchase.

Our current shipping rates and delivery information are available in our Shipping Policy.

For international orders, customs duties, import taxes or other local charges may apply. Where applicable, these charges may be payable by the recipient and are outside our control unless we expressly state otherwise at checkout.

7. SHIPPING AND DELIVERY

We aim to deliver orders within the estimated delivery timeframe displayed on our website and in our Shipping Policy.

Our current estimated delivery time is approximately 8 working days, although delivery times are estimates and not guaranteed unless we expressly agree to a specific guaranteed delivery date.

Working days exclude weekends and applicable public holidays.

Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier disruption, customs processing, severe weather or other unforeseen events.

If there is a significant delay, please contact us and we will investigate.

Products remain at our risk until they are delivered into the physical possession of you or a person identified by you to receive them, except where applicable law provides otherwise.

Our current shipping arrangements are:

UK orders: Free shipping, with no minimum order value.

International orders: £10 flat-rate shipping per order.

Further information is available in our Shipping Policy.

8. RETURNS, CANCELLATIONS AND REFUNDS

Your rights to cancel an order, return a product or receive a refund are explained in our Returns & Refunds Policy.

Nothing in that policy or these Terms affects any mandatory rights you have under applicable consumer law.

Where applicable law provides you with a cooling-off or cancellation period for an online purchase, those rights will continue to apply.

Unless otherwise stated or required by law, customers are responsible for the cost of returning products where the return results from a change of mind.

Different rules apply to faulty, damaged, incorrect or non-conforming products.

Please do not return products directly to our production or fulfilment partner unless we specifically instruct you to do so.

Contact connect@swenkastreetwear.com before making a return so that we can provide the appropriate return instructions.

9. FAULTY, DAMAGED OR INCORRECT PRODUCTS

We want every SWENKA® order to reach you in the condition expected.

If a product arrives damaged, defective, incorrectly printed or you receive an incorrect item, please contact us as soon as reasonably possible at:

connect@swenkastreetwear.com

Please include your order number, details of the problem and, where reasonably possible, photographs showing the issue.

Depending on the circumstances and your applicable statutory rights, we may offer a repair, replacement, price reduction, refund or another appropriate remedy.

Nothing in these Terms limits your legal rights where goods are faulty, damaged, not as described or otherwise fail to conform to your contract with us.

10. INTELLECTUAL PROPERTY AND TRADEMARKS

The content of this website, including the SWENKA® name, trademarks, logos, graphics, artwork, garment designs, prints, photographs, videos, text, product names, slogans, website design and other creative materials, is owned by or licensed to Swenka® Limited unless otherwise stated.

SWENKA® is a registered trademark protected in Ireland and the United Kingdom.

Our intellectual property is protected by applicable trademark, copyright and other intellectual property laws.

You may access and use our website for your personal and non-commercial use.

You must not, without our prior written permission:

  • copy or reproduce our artwork or designs;

  • use the SWENKA® name, logo or trademarks;

  • manufacture or sell products using our designs or branding;

  • reproduce or commercially use our photographs or other website content;

  • modify or create derivative works from our designs;

  • falsely suggest an association, partnership or endorsement by SWENKA®;

  • scrape, systematically extract or commercially reproduce content from our website; or

  • use our intellectual property in a way that infringes our rights.

Nothing on this website grants you any licence or other right to use SWENKA® intellectual property except for the limited personal use expressly permitted by these Terms.

All rights not expressly granted are reserved.

11. THIRD-PARTY SERVICES AND LINKS

Our website may contain links to third-party websites or use services provided by third parties.

We do not control third-party websites and are not responsible for their content, availability, privacy practices or terms.

Accessing third-party websites is at your discretion and you should review their applicable terms and policies.

12. SHOPIFY

Our online store is hosted by Shopify.

Shopify provides the technology and e-commerce infrastructure that enables us to operate our online store.

However, products purchased through the SWENKA® store are sold by Swenka® Limited, not Shopify.

Your contract for the purchase of SWENKA® products is therefore with Swenka® Limited.

Shopify may process certain information in connection with your use of our website and purchases. Further information about the processing of personal information is provided in our Privacy Policy.

13. PRIVACY

We take the protection of personal information seriously.

Personal information collected through our website is handled in accordance with our Privacy Policy and applicable data-protection legislation.

Because our store uses Shopify and other service providers, certain information may be processed by those providers in order to operate our website, process payments, fulfil orders and provide other necessary services.

Please read our Privacy Policy for further information.

14. CUSTOMER REVIEWS, COMMENTS AND CONTENT

Where we allow customers to submit reviews, photographs, comments or other content ("Customer Content"), you confirm that you have the right to submit that content.

Customer Content must not:

  • infringe another person's intellectual property rights;

  • violate another person's privacy;

  • contain unlawful, defamatory, threatening or abusive material;

  • contain malicious software;

  • impersonate another person; or

  • deliberately contain false or misleading information.

Where you voluntarily submit Customer Content for publication on our website or social channels, you grant SWENKA® a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for the purpose of operating and promoting SWENKA® and our products.

You retain ownership of your original content.

We may remove Customer Content that we reasonably believe violates these Terms or applicable law.

15. ERRORS AND INACCURACIES

Occasionally our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, availability, pricing, promotions, delivery charges or other information.

We may correct errors and update information where reasonably necessary.

Where an obvious error affects an order you have already placed, we will contact you as soon as reasonably possible.

If we cannot fulfil an order because of an error, we may cancel the affected order and refund any amount you have paid for it.

Nothing in this section limits your statutory rights.

16. PROHIBITED USE

You must not use our website:

  • for any unlawful or fraudulent purpose;

  • to infringe our intellectual property or the rights of another person;

  • to distribute viruses, malware or other harmful code;

  • to attempt to gain unauthorised access to our website or systems;

  • to collect personal information about other users unlawfully;

  • to send spam or unsolicited communications;

  • to impersonate another person or organisation;

  • to interfere with the security or operation of the website; or

  • to use automated systems to systematically extract our content for commercial exploitation without our permission.

We may restrict or terminate access to our website where we reasonably believe these Terms have been materially breached.

17. AVAILABILITY OF THE WEBSITE

We aim to keep our website and Services available, but we cannot guarantee uninterrupted or error-free access.

We may temporarily suspend access for maintenance, security, technical reasons or circumstances outside our reasonable control.

We may modify or discontinue website features from time to time.

Nothing in this section affects your rights in relation to orders that have already been accepted by us.

18. OUR LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or restricts:

  • your statutory consumer rights;

  • our liability for death or personal injury caused by negligence where such liability cannot lawfully be excluded;

  • liability for fraud or fraudulent misrepresentation; or

  • any other liability that cannot lawfully be excluded or limited.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.

If you are purchasing as a consumer, we are not responsible for business losses, including loss of profit, revenue, business opportunity or business interruption, arising from your personal use of our products.

We are not responsible for losses caused solely by circumstances outside our reasonable control where permitted by applicable law.

Nothing in this section affects any mandatory rights or remedies available to you under applicable consumer law.

19. INDEMNITY

If you use our website for commercial purposes or in breach of these Terms, you may be responsible for reasonable losses or costs that we incur as a direct result of your unlawful use or infringement of our intellectual property rights, to the extent permitted by applicable law.

This section does not limit any rights or protections available to consumers under applicable law.

20. TERMINATION OR RESTRICTION OF ACCESS

We may suspend or restrict your access to our website where we reasonably believe you have materially breached these Terms, engaged in fraud, attempted to compromise the security of our website or used our Services unlawfully.

Termination or restriction of website access does not affect rights or obligations relating to orders already entered into, except where applicable law permits otherwise.

21. SEVERABILITY

If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue in effect.

22. WAIVER

If we do not immediately exercise a right available to us under these Terms, that does not mean that we have waived that right.

A waiver on one occasion does not constitute a waiver on another occasion.

23. CHANGES TO THESE TERMS

We may update these Terms from time to time, including to reflect changes to our business, Services or applicable law.

The latest version will be published on this page together with the date on which it was last updated.

Changes will not retrospectively alter the terms applicable to an order that has already been accepted unless required by law or agreed with you.

24. GOVERNING LAW AND JURISDICTION

These Terms and any contract between you and Swenka® Limited are governed by the laws of Ireland, subject to any mandatory consumer protections that apply in the country where you live.

If you are a consumer resident in another country, including the United Kingdom, nothing in these Terms deprives you of mandatory consumer protections available to you under the laws applicable to you.

Nothing in these Terms restricts any right you may have under applicable law to bring proceedings before a court with jurisdiction over your consumer claim.

25. ENTIRE AGREEMENT

These Terms, together with our Returns & Refunds Policy, Shipping Policy, Privacy Policy, Cookie Policy and any other terms expressly presented to you when placing an order, form the agreement between you and SWENKA® concerning your use of our Services and purchase of our products.

If there is an inconsistency between these Terms and a specific term expressly provided to you in relation to an order or promotion, the more specific term will apply to the extent of that inconsistency, subject always to applicable law.
